Our Law Office takes pride in our reputation in providing attentive, thorough and first-rate legal representation in criminal cases, at trial, on appeal, and in state and federal post-conviction relief. We specialize in criminal defense.
We all make mistakes, but your mistake should not permanently have an impact on the rest of your life.
There is no doubt that being charged with a crime can alter your life. It does not always have to be that way. Having the right criminal defense attorney working with you to minimize the charges or mitigate the case on your life can make the difference in whether or not your criminal charge impacts you for years to come.
We have over 16 years of experience successfully defending clients in trial and resolving cases outside of court. Our careers have been dedicated to defending the rights of people who have been accused of crimes. We will guide you the legal system and explain the options available to you under the law. You will be nervous, scared, worried and under stress, but we can help alleviate those problems by explaining the legal process.
What sets us apart from other defense lawyers?
One thing you will notice immediately in dealing with our firm is that we will never convince you to take a plea or settle if you are intent on going to trial. That is your right. Of course, we will advise and educate you, but you will make the final decision about the course of action. When you are a client, we are a team. We will help you understand the options and consequences so you can make the best decision for your situation.
If you want a trial, we will fight for you. Other attorneys might try to discourage you from going to trial because it can be anxiety-inducing, too time intensive or costly for them. We do not think that way. We have represented people in some of the hardest cases and most difficult of charges in state, federal court and appeals courts. We do not shy away from any case or charge. We care most about the best possible outcome so you can move on with your life. When you hire our firm you will always have two lawyers working on your case in your best interest.
We are committed to providing tough and aggressive legal representation, while also providing personally responsive to your needs. It is our firm policy to promptly respond to all calls and messages either immediately or within hours, including weekends and evenings. If anything, we tend to provide numerous conversations on your case. It is our policy to provide each client with frequent, detailed updates through all modes of correspondence. We work with you to make sure your voice is heard.
How will you know what an attorney has to offer?
While many people simply guess and hope for the best, that should never be the method for selecting an attorney. You should call, meet and talk with your prospective attorney. You should feel comfortable asking for information on what the attorney has to offer. If you feel comfortable you will feel confident the attorney will work in your best interest. This will provide you with peace of mind in that you know your attorney did everything that could be done on your behalf.
To make you confident we promise to provide you:
James was born and raised in Michigan. He is a 2004 Graduate of Wayne State University Law School. While in law school I served as Editor-In-Chief of the Moot Court program.
I also interned at the State Appellate Defender Office, Federal Defender Office and Wayne County Prosecutor's Office. When I became an attorney I did volunteer work for the ACLU on criminal cases.
For over 10 years, I have successfully dedicated myself to criminal defense. I have handled every aspect of the criminal justice system from trials to appeals. I have handled cases ranging from traffic tickets to murder. I have represented clients in federal court with charges ranging from conspiracy, alien smuggling, and union fraud among other charges.
I am an experienced litigator who has successfully taken jury and bench trials to verdict. I have received not guilty verdicts on felony and misdemeanor cases ranging from criminal sexual conduct, assault with intent to murder, domestic assault, and assault and battery among others. I have successfully had cases dismissed at preliminary examination or from motions to suppress for illegal searches and seizures.
I have appealed cases to the Michigan Court of Appeal, Michigan Supreme Court and Federal Court where my clients' convictions were overturned and given new trials or had sentences changed. If there is a legal issue, I will find it.
Litigation is not always the answer. I have negotiated cases to avoid convictions, get charges reduced, and avoid jail or prison sentences. I have negotiated with local prosecutors, United States Attorneys, FBI and the ATF.
In essence, I have dedicated my career to fighting for people in my community. I will do the same for you.
I work tirelessly on my cases. I never give up on any case because I know it is important to my clients. I operate with one philosophy, every client deserves the right to the best legal representation no matter his or her background.
It is upon that deep belief that I have built my entire career. I believe that there is always hope for every client and every avenue should be pursued regardless of the time and energy it takes. For me, creating the finest criminal defense for my clients must be applied in every case.
I have successfully litigated both felony and misdemeanors cases. I have had motions granted to dismiss cases and suppress evidence. I have assisted in appeals that resulted in overturned convictions for our clients.
When litigation is not an option I successfully negotiate with city attorneys and prosecutors to have charges reduced, dismissed and/or avoid incarceration. I focus on avoiding convictions at every opportunity.
I have the ability to work with clients no matter what their legal needs. I try to put people at ease and guide them through the legal process. The client's needs come first.
While I do criminal defense, when approached, I also represent clients in divorce, custody matters and civil cases. Solutions to these issues come in many forms including pre-litigation resolution, mediation, arbitration, litigation and trial. I have experience in those solutions.
I care about you, and I care about the effect your case has on your family and your life. So we listen closely to your needs. We return your phone calls as quickly as possible.
Whether it is in court or behind the scenes with judges, prosecutors and police, I will use my experience, professional relationships and persistence to fight hard for you.
You may have been charged with a crime, but that does not mean you are guilty. We know and understand the difference. We are on your side.
At CZARNECKI & TAYLOR, we take the time to listen, to find the right answers and provide the best care and representation.
Everyone has heard of the saying "innocent until proven guilty." Unfortunately, the reality is, our criminal justice system puts the accused at a serious disadvantage and on the defense as soon as you are accused of a crime. Juries are often inclined to presume guilt. The prosecution's case has started before you even have an opportunity to start your defense. This is why you need an attorney who starts your defense before you enter a courtroom.
Our firm starts working on your defense immediately, the same day you meet and retain us. We will explain our strategy as soon as you meet us. We cannot overstate this one important fact: You need aggressive criminal lawyers to defend your rights and work on your defense immediately and before you go to court.
Our firm is very aware of how a criminal record can impact your life. We know a conviction impact your work, benefits, license, custody. This is why we diligently prepare your case. Unlike many law firms, you are not just a case file. We take personal care with each of our clients to ensure open, honest, and direct communication. We serve you based on your individual and unique needs.
We know your goals. Therefore, our first priority is avoidance of a criminal conviction. We understand criminal convictions will alter people's lives. At times, if we are retained early enough at the investigative stage we can make legal decisions to prevent charges from being filed. Your goal is our goal in the sense that getting charges dismissed or reduced is at the top of the list of things that we need to do for you, aside from keeping you out of prison or jail.
There are different ways to achieve this goal. Depending upon the facts of each case, our goal may be to reduce a felony to a misdemeanor, negotiate a deal where you avoid a conviction, avoid incarceration, or other severe penalties associated with a conviction. Sometimes, we must file motions to suppress evidence or challenge arrests. When the time comes, you may need to go to trial. We will provide you with a practical and honest assessment of your case. We will evaluate and explain all of your options. We will do everything we can to protect you because your case not only affects you but it affects your children, employment, family and significant others.
Through our years of legal experience, we have developed longstanding ties to the Michigan legal community. Because of the relationships to the Michigan court system, the corrections system, attorneys, and other professionals, we are able to effectively put together a plan in a wide variety of criminal cases, trials and appeals.
